LHC Hears Petition in Sarabjit Kaur Case

The Lahore High Court heard a petition filed by Karnal Singh, the Indian husband of Sarabjit Kaur. The case was taken up by Justice Farooq Haider.
Advocates Ali Changezi Sandhu and Muhammad Nawaz Sheikh presented arguments regarding objections raised by the Registrar’s Office. The court directed that international laws and judicial precedents concerning the Special Power of Attorney be submitted and adjourned the hearing until March 2, 2026.
The bench questioned why the Special Power of Attorney of the Indian citizen had not been certified by the Ministry of Foreign Affairs.
Responding to the query, Advocate Ali Changezi Sandhu argued that the Special Power of Attorney Act applies only to Pakistani citizens and overseas Pakistanis. Since Karnal Singh is an Indian citizen and does not possess a Pakistani identity card, the Pakistani High Commission in London does not process such registration; therefore, the document was certified by a solicitor.
The court further asked what Pakistani law states regarding the granting of a Special Power of Attorney to a Pakistani citizen by a foreign national. The counsel replied that Pakistani law is silent on this point, making the case unique and requiring reference to international legal instruments, including those under the United Nations framework.
The court ordered that relevant international laws and precedents be presented at the next hearing.
It is noteworthy that Karnal Singh has petitioned for his wife’s extradition, declaring her marriage to a Pakistani citizen null and void without obtaining a divorce from him.
